Freehold Ownership
The Somerset offers the option of freehold title ownership, which is the simplest capital structure for retirees. Owners receive the title deeds and have the property registered in their own name(s). Under the Housing Development Schemes for Retired Persons Act of 1988, purchasers can be freehold owners of an erf and dwelling in a retirement village. Owners also benefit from protection under existing South African property laws.
When the property is sold, 25% of the net profit is paid into The Somerset levy stabilisation fund. The Home Owners Association (of which you will be a member) uses this fund to subsidise levy increases in times of high inflation.
Rates & Taxes
Under this form of ownership you are liable for:
- Rates and taxes
- Home insurance
- Internal home maintenance
- Levy of the Homeowners Association.
Levies are cost recovery mechanisms with a fixed portion and a variable portion that is dependent on the size of your property. Levies cover costs associated with common facilities and services such as catering, security, garden services and general healthcare as well as external maintenance on all properties.
Additional healthcare services are available in your home or at the Health Care centre.
Various Floor Plans to Choose From
The Somerset offers a variety of floor plans from which to choose. All houses are fully compliant with the SANS energy-saving building regulations, and plans can be amended to suit your needs.
A 6-month period is generally allowed from the time of signature until completion with the plot transferring into the purchaser’s name before building to an agreed building contract, with phased progress payments.
Life Right Ownership
A Life Right purchase is a transaction where you and your spouse/partner, as the nominated occupants, attain the right to live in a particular apartment for the duration of your lifetime. After this point, your capital is returned with an additional profit share, depending on the options chosen.

What is Life Right Ownership?
Life Right Ownership is a very widely practiced form of retirement home sales worldwide.
There are no transfer costs attached to a Life Right purchase as there is no transfer of property taking place.
No Value Added Tax (VAT) on your Life Right purchase
At the time of sale, all levies must be contractually fixed for the first year and estimated for the following two years.
In addition, the Life Right property owner is the Cape Peninsula Organisation for the Aged (CPOA), a non-profit organisation with a 65-year track record in caring for the aged.
The Somerset’s Life Right Ownership offers a flexible range of pricing and contracts. This allows for a capital contribution that suits you.
The Life Right purchaser is not liable to pay rates and taxes to the municipality.
Buyers are protected under the terms of the Housing Development Schemes for Retired Persons Act. Therefore, buyers have the security of knowing that their right of occupation is protected by law.
Included in your levy is the external maintenance of your home, building house insurance and rates.
Furthermore, Life Rights purchased from CPOA can be traded with Life Rights in other CPOA villages. This is a service unique to the CPOA, and made possible due to the fact that the organisation has a large number of residential developments throughout the Western Cape.
